An EIN and an ITIN serve different purposes. An Employer Identification Number identifies a business or other entity for tax administration. An Individual Taxpayer Identification Number is for an individual who needs a US federal tax identification number and is not eligible for a Social Security number. A business owner may need to discuss both, but the numbers do not replace each other.
For a non-US business owner, the first question is whose identification number is needed and why. This guide focuses on that decision. It does not repeat the full company-formation process covered in our business setup guide.
EIN vs. ITIN: the practical difference
| Question | EIN | ITIN |
|---|---|---|
| Who is it for? | A business or other entity that needs an employer identification number. | An individual with a federal tax purpose who is not eligible for an SSN. |
| Which application is involved? | Form SS-4 or an eligible IRS online EIN application. | Form W-7 and the required supporting documentation. |
| Does it replace the other number? | No. It is not the owner’s individual tax identification number. | No. It does not replace an entity’s EIN. |
Start with the IRS explanations of EIN applications and ITIN eligibility. The table summarizes their different purposes; your entity and filing circumstances determine the next step.
Does owning a US company automatically mean you need an ITIN?
No. The IRS states that an ITIN is not issued solely for starting a business, e-commerce or opening a bank or investment account. The individual needs a qualifying federal tax purpose. Ownership of a company, by itself, is not a reason to assume that a Form W-7 application is appropriate. See IRS Topic 857.
Keep the company’s requirements and the owner’s requirements separate during the consultation. Ask which return, reporting obligation or other federal tax purpose creates the need for each number. That is more useful than requesting an identification number without first identifying how it will be used.
Can a foreign owner apply for an EIN without an SSN or ITIN?
There are circumstances addressed by the IRS instructions. Form SS-4 has specific guidance for a responsible party who does not have, and is ineligible to obtain, an SSN or ITIN. That condition matters: simply not having a number is not the same as being ineligible for one. Review the Form SS-4 instructions for lines 7a–7b before deciding how to proceed.
The IRS online EIN tool also has eligibility conditions, including requirements concerning the business location and responsible party’s identification. Do not assume every applicant can use the online process. Use the current IRS application guidance to identify the route that applies to your circumstances.
What does an ITIN application involve?
Form W-7 is the application for an ITIN. The supporting package generally includes a federal tax return unless an exception applies, along with documentation establishing identity and foreign status. The applicable exception and document rules should be reviewed before sending an application. The IRS Form W-7 instructions explain these requirements.
A useful preparation step is to identify the federal tax purpose, check whether the person is eligible for an SSN and gather the information needed to assess the application. Do not send identity documents through a public enquiry form. Agree on a secure method of sharing records with the professional assisting you.
A checklist before requesting application assistance
- Confirm whether the question concerns the business, an individual owner or both.
- Have the entity’s legal name, formation details, ownership information and address information available.
- Identify the person who controls the entity and discuss the responsible-party requirements.
- Locate any existing EIN confirmation or prior ITIN correspondence before starting another application.
- Explain the filing or reporting purpose and the deadline you are working toward.
- Ask what the professional will prepare, what you must supply and what the quoted fee covers.
Common mistakes to avoid
Treating every tax identification request as the same application
A request relating to the company and one relating to the owner can involve different information and procedures. Keep a written record of which applicant, purpose and application route you have discussed.
Confusing an IRS fee with a professional service fee
The IRS issues EINs without a fee. If you hire someone to assist, ask them to distinguish their service charge from any government charge. A paid assistance service does not create a faster IRS approval guarantee.
Assuming the number resolves every compliance question
An identification-number application is one task. Ask separately about the company’s and owner’s ongoing filing responsibilities. Our international tax services page explains the broader support to discuss.
Frequently asked questions
Do I need the ITIN before I can request an EIN?
Do not assume a universal sequence. Review the entity’s EIN need, the responsible-party rules and any separate individual federal tax purpose. The answer should follow those facts rather than a checklist that treats every foreign owner identically.
Does an ITIN give permission to work in the United States?
No. The IRS says an ITIN does not authorize employment or provide or change immigration status. Its purpose is federal tax administration. The IRS ITIN eligibility page explains these limits.
How long will the application take?
The route used, completeness of the application and IRS processing affect timing. Check the current IRS guidance when applying and distinguish time spent preparing documents from government processing. Do not rely on an unqualified same-day promise.

Questions to bring to your CPA consultation
What should I clarify before requesting ITIN application assistance?
Explain the individual’s federal tax purpose, existing identification numbers and previous application history. Ask what help completing an ITIN application includes and how supporting documents will be handled securely. ITIN application assistance for non-US residents should begin with eligibility and purpose, not an assumption that every US company owner needs one. Confirm the application scope separately from any tax-return preparation work.

What should a new LLC ask about EIN application assistance?
Have the company’s legal name, formation details and ownership information available, and identify any earlier EIN application. Ask who will be named as responsible party and which application route fits the facts. EIN assistance for non-US business owners should address the relevant identification and eligibility questions rather than promise universal online approval. Confirm whether the professional engagement also includes accounting setup or later filings; those are separate tasks.
